Terms of Service
Effective date: 25 July 2026 · These terms are an agreement between you and ImpactSpring Smart Farm, a business registered in Papua New Guinea ("MELscope", "we", "us").
1. The service
MELscope is a web-based monitoring, evaluation and learning (MEL) platform for development projects: indicator tracking, results frameworks, site mapping, milestone tracking, a data-entry and approval workflow, a beneficiary register, an evidence repository, and report generation. Features described as "coming soon" are not part of the current service and may change.
2. Accounts and access
- Projects are onboarded by request. After we approve a request and agree terms, we create the project workspace and link it to the client's account(s).
- You are responsible for keeping your credentials secure and for the actions taken under your account. Notify us promptly of any suspected unauthorised access.
- Project owners control who joins their project (via invites) and what external stakeholders can see (via share links). Owners are responsible for reviewing and revoking access when team members leave.
3. Your data
- You own your project data. We claim no rights over the indicators, documents, records or reports you create, beyond what is needed to operate the service.
- You can export your data (Excel and documents) at any time, including after your project closes.
- You are responsible for the lawfulness of the data you enter — in particular, for having consent or another lawful basis to record identifiable beneficiary information, and for the accuracy of the results you report to donors. See our Privacy Policy.
4. Fees and activation
- Building your framework and entering data is free. The live dashboard and report generation activate when the agreed fee is received (bank transfer unless otherwise agreed).
- Fees are agreed per project in your access agreement, based on project size. Published prices are indicative.
- Fees are non-refundable once the dashboard has been activated for the paid period, except where required by law or where we fail to provide the service.
- If renewal payment is not received, the project may be marked past-due and eventually frozen (read-only). Frozen projects retain export access.
5. Acceptable use
You agree not to: attempt to access other organisations' projects or data; probe, disable or overload the service; upload malicious code; use the service for unlawful purposes; or resell access without our written agreement. We may suspend accounts that put other clients' data at risk, and will tell you why.
6. Availability and support
We aim to keep the service available at all times but do not guarantee uninterrupted availability. We may perform maintenance, and we depend on third-party infrastructure that we do not control: Supabase and Amazon Web Services for hosting and the database, Cloudflare for delivery, the cdnjs and jsDelivr code distribution networks, from which your browser loads the open-source libraries the application is built on, and CARTO for site map tiles. An outage at any of these can make the service, or part of it, temporarily unavailable. We will make reasonable efforts to give notice of planned downtime and to restore service promptly after failures. Support is provided by email at info@melscope.com.
7. Intellectual property
The MELscope software, brand and design remain our property. We grant you a non-exclusive, non-transferable right to use the service for your projects while your subscription is active. Feedback you give us may be used to improve the service without obligation.
8. Liability
- The service is provided "as is". To the maximum extent permitted by law, we exclude implied warranties.
- We are not liable for indirect or consequential loss (including loss of funding, profits or reputation), or for decisions donors make based on reports generated from your data.
- Our total aggregate liability under these terms is limited to the fees you paid us in the 12 months before the claim arose.
- Nothing in these terms excludes liability that cannot be excluded under the laws of Papua New Guinea.
9. Termination
- You may stop using the service and request deletion of your project at any time.
- We may terminate for material breach of these terms with 14 days' written notice (immediately for serious security abuse).
- On termination, you have 60 days to export your data before deletion, unless the law requires us to keep it longer.
10. Governing law
These terms are governed by the laws of the Independent State of Papua New Guinea. The parties will first attempt in good faith to resolve any dispute by negotiation; failing that, disputes are subject to the exclusive jurisdiction of the courts of Papua New Guinea.
11. Changes
We may update these terms as the service evolves. Material changes will be notified to account holders by email at least 14 days before they take effect. Continued use after that date constitutes acceptance.
